Customer Terms and Conditions

These Terms and Conditions ("Agreement") govern your purchase of a puppy through Fairfield Cityview LLC, a Delaware limited liability company ("Seller"). By placing an order on our website, you agree to the following terms:
1. Sale Location and Governing Law
The transaction for the sale of the puppy is deemed to occur in the State of Delaware through the Seller's online platform. This Agreement is governed by the laws of the State of Delaware. All sales, payments, and confirmations are completed electronically prior to delivery.
2. Reservation and Payment
To reserve a puppy, the Buyer must pay a non-refundable, non-transferable deposit online. This deposit secures a specific puppy and represents a binding commitment to purchase. The remaining balance must also be paid online prior to delivery, and the delivery appointment shall occur no less than 24 hours after full payment.
The puppy must be delivered within 7 days of the availability date. Requests to hold the puppy beyond 7 days require written approval by management and incur a $50 per day penalty.
All payments made are final and non-refundable.
3. Delivery Policy
Delivery of the puppy is arranged after the sale is completed online. Delivery may occur at a scheduled pickup location or directly to the Buyer’s home via ground transportation or airline delivery, where applicable.
The Buyer understands and agrees that:

The sale is completed prior to delivery.

The Buyer is the legal owner of the puppy upon completion of purchase. Delivery is a logistics service only.

Delivery is by scheduled appointment or coordinated home arrival.
4. Compliance and Legal Structure
The Seller coordinates and completes the sale electronically prior to delivery of the puppy. The transporter provides delivery logistics only and does not house animals for sale or engage in any sales activity.
5. Registration Papers
If the puppy is advertised as having registration papers, the Seller will work with the breeder to provide them. Typically, registration papers are received within 14 days. If papers are not received within 30 days of delivery, please contact us at [email protected]. The Seller is not affiliated with any registry and is not responsible for registry delays or decisions.
6. Size and Health Disclaimers
Adult size and weight estimates are based on breed, parent size, and historical data, and are not guaranteed. Mixed breeds may favor one parent more heavily. Small breeds may be predisposed to certain health concerns. Our warranty outlines your protections, and we recommend pet insurance.
7. Health Guarantee and Insurance Requirements
The Buyer is responsible for understanding our health guarantee in its entirety.
Fairfield Furbabies provides a 10-year replacement guarantee and cash medical reimbursement policy for hereditary and congenital conditions, contingent upon active enrollment in Major Medical Pet Insurance.
Eligibility:

Insurance must be active before the puppy’s delivery and maintained continuously for 6 months for replacement eligibility.

For reimbursement, insurance must remain active throughout the 10-year period.

Fairfield Furbabies covers 100% of your deductible up to $300 and co-pay for eligible conditions.

Viral illnesses (Parvo, Distemper, Hepatitis, Coronavirus) are covered for 10 days post-delivery with proof of insurance enrollment prior to arrival.

Initial vet exam must occur within 7 days of delivery (no vaccines at first visit).

Sudden death requires a necropsy for full replacement; without one, a 50% credit (up to $2,000) toward a future puppy will be provided.
No cash refunds are offered. Reimbursements and replacements are capped at the purchase price of the puppy. Breeding fitness is not guaranteed. Seller reserves the right to require documentation from your pet insurance provider to verify coverage before any reimbursement is issued.

8. Buyer Acknowledgment of Responsibility
The Buyer acknowledges sole responsibility for the ongoing care, training, and medical attention of the puppy after delivery. The Seller makes no guarantees regarding temperament, behavior, or future health beyond the provided health guarantee.
9. Communication and Consent
By completing your purchase, you consent to transactional communications via email or SMS. You may opt out of marketing emails at any time.
10. No Guarantee of Breed Classification
Breed classifications provided are in good faith based on breeder or registry information. The Seller disclaims liability for inaccuracies.
11. Right of Refusal
Seller reserves the right to refuse or cancel the sale at any point prior to delivery if the Buyer is deemed not a good fit for the puppy or for any other reason at the Seller's sole discretion. In such cases, a full refund will be provided.
12. Abandonment Clause
If the puppy is not delivered within 14 days after the scheduled delivery date without written approval from Seller, the puppy will be considered abandoned. The Buyer forfeits any payments, and the puppy may be resold or rehomed by Seller.
13. Force Majeure
Neither party is liable for delays or failures due to acts beyond reasonable control, including natural disasters, pandemics, severe weather, governmental restrictions, or transportation disruptions.
14. Indemnification
Buyer agrees to indemnify Seller and delivery provider from all claims, liabilities, or damages arising from Buyer’s negligence or breach of this Agreement after delivery.
15. Spay/Neuter Agreement
Puppies are sold strictly as pets and must not be bred unless explicitly approved. Buyer agrees to spay/neuter by 6 months of age unless a written exemption is provided by Seller.
16. No Breeding Fitness Guarantee
Seller explicitly provides no guarantee regarding the puppy’s suitability for breeding, even if breeding rights have been granted. Buyer accepts all associated risks.
17. Accuracy of Information
Seller endeavors to ensure accuracy online; however, errors may occasionally occur. Seller reserves the right to correct errors and modify orders accordingly.
18. Time Limitation on Claims
Any claim or legal action must be commenced within one (1) year from the date of delivery.
19. Legal Jurisdiction and Dispute Resolution
Disputes will be resolved through binding individual arbitration administered by the American Arbitration Association per its Consumer Arbitration Rules. Parties waive trial by jury and class action participation. Arbitration costs are equally shared unless otherwise decided by arbitrator. If arbitration is not feasible, disputes are resolved in New Castle County, Delaware.
20. Severability
If any provision is unenforceable, remaining provisions remain in full effect.
21. Amendments
These Terms and Conditions may be updated periodically. Continued use signifies acceptance of revised terms.
22. Health Certificates
All puppies shipped via airline will include a health certificate that must be presented at the airport. If lost or misplaced, please email us to request a digital shot record, which may take up to 3 business days. For puppies delivered locally or by ground delivery, a health certificate is not required unless otherwise stated.
23. Weight Estimates and Use of the Term "Teacup"
The term "Teacup" is used informally to describe smaller-sized breeds and is not a guarantee of adult size or weight. All size estimates are based on parent size, breed characteristics, and historical data and are not guaranteed. If a guaranteed adult weight is important, please select from puppies that specifically offer this in writing.
24. Availability Date Disclaimer
All advertised availability dates are estimates and may change based on the puppy’s developmental milestones. We reserve the right to delay delivery if we feel the puppy is not ready. If your preferred puppy is delayed, we may offer alternative options with earlier availability.
